    <summary type="text">Title: AN INVESTIGATION REPORT ON ALLEGED MANIFEST INJUSTICE IN THE ISSUANCE OF PASSPORTS BY THE DEPARTMENT OF IMMIGRATION

Abstract: The Commission undertook investigations into allegations that the Department of&#xD;
Immigration was overcharging citizens for passports. The investigation was&#xD;
Triggered by several complaints made online on social media via a Facebook&#xD;
Page called “Wanderlust Diaries Ltd” against the Department of Immigration.&#xD;
The Office of the Director General Immigration Services was notified of the&#xD;
Commission’s decision to investigate the matter on 3rd November 2022. The&#xD;
investigations team visited the Immigration offices and the Government Digital&#xD;
Payment Unit under the National Treasury, interviewed a number of officers as well&#xD;
as complainants, and obtained several documents relevant to the matter under&#xD;
investigation.&#xD;
All nine complaints alleging overcharge of passport fees were found to be true&#xD;
while the allegation by the Department of Immigration that the complainants&#xD;
edited their application to a lower series was found to be false. Investigations&#xD;
revealed that the Department of Immigration lacks an internal policy or a&#xD;
procedure guiding and regulating issues that may arise out of passport processing&#xD;
such as editing and cancellation of applications and also lacks a mechanism to&#xD;
automatically refund excess payments.&#xD;
Delays in the processing of passports and the unavailability of a particular passport&#xD;
series on the e-citizen platform were found to be occasioned majorly by two&#xD;
factors; delays in the approval of the procurement of blank passport booklets, and,&#xD;
the continuous breakdown of printing machines at the Department of Immigration.&#xD;
The e-citizen system was found to have eased and improved the efficiency of the&#xD;
passport application and payment processes but needs an upgrade to deal with&#xD;
emerging trends.&#xD;
In light of these findings, its recommended interalia that the Department of&#xD;
Immigration refunds all applicants with outstanding overpayment while formulating&#xD;
policy guidelines that will formalize and standardize the management of issues&#xD;
arising from the passport application processes.

Abstract: The Commission on Administrative Justice (CAJ) has a mandate, inter-alia, to investigate any conduct in state affairs or any act or omission in public administration in any sphere of Government and complaints of abuse of power, unfair treatment, manifest injustice or unlawful, oppressive, unfair or unresponsive official conduct. &#xD;
In this regard, the Commission undertook investigations into alleged dereliction of duty by various security organs and public officers in relation to the Garissa University Collage attack on the 2nd day of April, 2015. &#xD;
The following is a summary of the findings, analysis, conclusions and recommendations as informed by the investigations.&#xD;
i.	General information regarding the 2nd April, 2015 GUC attack. &#xD;
ii.	Allegation of inaction on prior intelligence/information on the attack at GUC.&#xD;
iii.	Allegation of inaction, delay and unresponsiveness by security agencies&#xD;
iv.	Alleged misuse of police air craft by the Commandant Kenya Police Air wing&#xD;

    <summary type="text">Title: REPORT BY THE OMBUDSMAN, KENYA ON INVESTIGATIONS INTO THE CIRCUMSTANCES SURROUNDING THE ACCIDENT INVOLVING THE RIOMA SECONDARY SCHOOL BUS ON JULY 10, 2013

Abstract: This investigation was initiated suo motu after highlights by media between10th to 12th July, 2013. The CAJ undertook broad investigation into matters surrounding the accident. In particular, the Commission sought to look into issues of inefficiency, ineptitude, incompetence and any other forms of omissions or commissions as would be classified as maladministration on the part of those public officials who were entrusted with the organization of the games within Marani Division of Kisii County. &#xD;
Specifically, investigation surrounded issues related to:- &#xD;
- Nepotism and irregular hiring of the driver of the ill-fated bus &#xD;
- Allegation of incompetence by the driver. &#xD;
- Alleged overloading and un-roadworthiness of the Rioma Secondary School Bus. &#xD;
- Allegation that the bus was over speeding &#xD;
- Allegation of un-responsive traffic officers who did not take action on the driver for overloading and over speeding &#xD;
- Flouting Transportation Safety rules by school administrators/committees. &#xD;
- Compensation for the injured and to the next of kin for those who died &#xD;
- Payment of charges for extra-curricular activities which are otherwise supposed to be provided for by the government under free and compulsory education policy &#xD;
The process of undertaking investigations into the said allegations included holding interviews with members of staff of Marani District Education Office (DEO), the police, school heads, teachers, students, parents and next of kin of the deceased. In addition, CAJ obtained relevant documents from various government and private sources necessary for the investigations. &#xD;
The investigations were conducted independently by the Directorate of Research and Investigations. Dr. Richard Belio Kipsang, the Principal Secretary Ministry of Education was notified of the investigations through a letter dated 7th August, 2013

    <summary type="text">Title: “DEATH OF INTEGRITY”

Abstract: CAJ undertook investigations into the alleged irregular appointment of Mr. Yusuf Mahamed Fazul to the position of Executive Director, NGOs Coordination Board without the required academic and professional qualifications, and relevant work experience; irregular promotions and transfers staff; victimization and intimidation of staff; mismanagement of public funds and unprocedural procurement for services of Sagana Getway Resort to host a management meeting and sourcing for Max Worth Firm to facilitate team building. The investigation was prompted by anonymous complaint letters received by the Commission. &#xD;
Pursuant to Section 37 of the CAJ Act, 2011, CAJ wrote to the Principal Secretary, Ministry of Devolution and planning to inform him of its decision to conduct investigations into the allegations. CAJ investigators conducted interviews with selected public officials from NGOs Coordination Board and recovered documents relevant to the investigations. The former Board members were also interviewed. The information collected was analyzed leading to the following findings, conclusions and determinations.
