Abstract: In this Edition, the Commission, in partnership with the Geneva Centre for&#xD;
Security Sector Governance (DCAF), held a public inquiry in Wajir County&#xD;
on the barriers to the acquisition of legal identity documents including birth&#xD;
and death certificates, identification cards and passports by the residents&#xD;
of the county. The Commission also continued redress administrative&#xD;
wrongs in the public sector with one of the notable cases being the case of&#xD;
Mr. Parminas Oyori Monayo, a former employee of the National Cereals&#xD;
and Produce Board (NCPB) who was reinstated to his job following the&#xD;
implementation of a formal determination of the Commission on&#xD;
Administrative Justice (Office of the Ombudsman) which recommended&#xD;
that the Board reinstates him to continue serving as its officer with no loss of&#xD;
benefit.&#xD;
The Commission found that the decision by the Board to retire the&#xD;
employee from service on account of age amounted to unlawful&#xD;
termination and that the Board did not have the power to retire the&#xD;
employee at the age of 60 years since he had not attained the mandatory&#xD;
retirement age for persons with disability.&#xD;
In this edition, the Commission also undertook a systemic investigation on&#xD;
remote accessibility of selected public institutions in various sectors. The&#xD;
investigation revealed that most public institutions have functional websites&#xD;
and have put in place sufficient infrastructure for remote accessibility. The&#xD;
investigation, however, established that the availability of remote&#xD;
accessibility infrastructure in most institutions was inadequate in facilitating&#xD;
effective complaints management as some telephone numbers were not&#xD;
working, unresponsiveness to email inquiries, and service charters with no&#xD;
clear response to inquiries and complaints management.&#xD;
The Commission also upscaled capacity building of public officers and&#xD;
public awareness and education for the public on its mandate and the&#xD;
complaints handling procedure to enable the public to be able to file&#xD;
complaints with the Commission both under the administrative justice and&#xD;
the access to information mandates.&#xD;

Abstract: This newsletter torches on Huduma Ombudsman Awards Winners&#xD;
Promoted. Winners of the Huduma Ombudsman Awards (2015) – an awards scheme&#xD;
that recognises exemplary service in public service - have been promoted.&#xD;
Mr. Samwel Kimiti who emerged winner in the individual category has been&#xD;
promoted from position of Deputy County Commissioner II (Job Group P) to&#xD;
Senior Deputy County Commissioner (Job Group R).The Commission continues to&#xD;
contribute to promotion of good&#xD;
governance, constitutionalism and&#xD;
public administration in various ways,&#xD;
including through membership to key&#xD;
taskforces.

Abstract: For the 1st time, the Commission joined the rest of the world in marking the&#xD;
International Day for Universal Access to Information (IDUAI). UNESCO&#xD;
rst designated the 28th September as IDUAI in 2016 following the adoption&#xD;
of a resolution (38 C/70) on November 17, 2015 declaring 28 September of&#xD;
every year as IDUAI.&#xD;
As part of efforts to implement the Access to&#xD;
Information Act, the Commission has in the past few&#xD;
months trained more than 100 senior managers from&#xD;
public institutions. The Commission has the mandate of overseeing and&#xD;
enforcing implementation of the Access to Information&#xD;
Act. The Commission has since handled 42 applications&#xD;
for review of decisions of public and private institutions&#xD;
on access to information requests.As part of a public outreach programme, the Commission undertook community outreach in Mukuru kwa Njenga,&#xD;
Kiambiu and Korogocho in collaboration with the Ombudsman Committee members of the three informal settlements. The Commission, in pursuit of its mandate to create&#xD;
awareness and educate members of the public on&#xD;
administrative justice issues, took part in this year's Legal&#xD;
Awareness Week.

Abstract: The institution of Ombudsman is the people’s representative that ensures the government delivers on its&#xD;
services to the people. Its mandate is to fight impunity&#xD;
and inefficiency in the public sector institutions at&#xD;
national and county level and enforce access to&#xD;
information as enshrined in the Constitution and&#xD;
Access to Information Act, 2016.&#xD;
The Constitution requires state officers/ public officers&#xD;
to be responsive when serving the public. It expects&#xD;
that public officers shall be servant and not rulers, and&#xD;
that the members of the public are treated with&#xD;
decorum and respect. However, a number public&#xD;
servants do not have a full understanding of what is&#xD;
expected of them by the Constitution and the Commission on Administrative Justice Act.&#xD;
The Commission on Administrative Justice (Office of&#xD;
the Ombudsman) in Kenya promotes and protects&#xD;
individual rights, encourages efficient public administration. As the Commission’s slogan goes, "Hata&#xD;
Mnyonge ana Haki," the Commission is committed to&#xD;
ensuring that Kenyans enjoy effective and efficient&#xD;
public services.&#xD;
In this edition, we take you down memory lane with&#xD;
the Huduma Ombudsman Award and it’s benefits to&#xD;
the previous three editions' awardees. This financial&#xD;
year, the commission plans to host the 4th Edition of&#xD;
the Huduma Ombudsman Awards.&#xD;
 In addition, the Commission fully participated in the&#xD;
observation and monitoring of the General election&#xD;
that was held on the 9th August, 2022. The Commission also hosted observers from the African Ombudsman and Mediators Association who observed elections and released a preliminary report.&#xD;
The Commission also marked this year's International.&#xD;
Day for Universal Access to Information in Bungoma in&#xD;
partnership with Kituo Cha Sheria by raising public&#xD;
awareness and education through radio programs,&#xD;
public forums and legal clinics. Our Mombasa office&#xD;
also held a public forum at Majaoni in Kisauni. The Commission also released a report on systemic&#xD;
investigations into the plight of Kenyan migrant&#xD;
domestic workers in the Kingdom of Saudi Arabia.&#xD;
As per its stragegic plan 2019/2023, the Commission&#xD;
continued to decentralise its services to the grassroots level. In collaboration with our sister Commission, the National Gender and Equality Commission, the Commission launched its Garissa Regional&#xD;
Office, which will also serve the North Eastern&#xD;
Region counties of Wajir and Mandera.&#xD;
We also have inspiring stories of Kenyans we have&#xD;
helped with complaints ranging from pensions to&#xD;
inmates getting appeal dates and retirement benefits, among other things.&#xD;
We hope you will find the stories in this issue inspiring&#xD;
as we continue to work together to build a society&#xD;
that upholds administrative justice and access to&#xD;
information.
